Products shipped by jewelry makers are pooled by our independent logistics partner in a packing center in Ireland, so you only have to pay one shipping fee even if your order includes jewelry from multiple jewelry makers. The package shipped contains all the certificates / invoices required by law. Tracking details of your order will be provided by our logistics partner via email.

Terms and Conditions (GTC)

 

1. Introduction:

Anyone browsing the Crystal Qveen Jewelry Webshop (hereinafter the "Webshop") shall comply with the relevant provisions of these Terms and Conditions (hereinafter the "Terms and Conditions"). In the Webshop, the User who provides the information necessary for the purchase and accepts this GTC (hereinafter the "Buyer") may purchase. The Webshop is the property of the Crystal Qveen LTD. (hereinafter referred to as "Seller"). By sending and confirming the order in the Webshop, a distance contract is entered into between Buyer and Seller, which will not be separately booked and filed.

3. Webshop Products

The detailed description of the products can be found on the information page of the given jewelry item under the Description menu, including price, material composition, fineness, hallmark, surface, weight, outer, inner profile, width, color information (in text and image). The Seller will use its best endeavors to present the essential features of the products in the most credible manner possible, in particular to make the colors more realistic. In some cases, the visible colors may differ from the reality as they are highly dependent on the monitor / display used by the Buyer and its configuration, and the Seller assumes no responsibility for any consequential damages.
The images shown are for illustration purposes only and may differ from the ordered product.

4. Price of products

The purchase price of the product is the final price to be paid (after selecting the appropriate parameters) next to the selected product, which is expressed in HUF. Our company will issue an English / Hungarian subject free VAT invoice. Shipping costs are not included in the product price. Seller does not charge extra for packaging. Shipping costs are borne by the Buyer and are invoiced as additional costs for the selected products. The Seller reserves the right to change the price on the grounds that the price indicated in the order sent by the Buyer is not necessarily applicable. After processing the order, the Seller will confirm the actual price, thus eliminating the incorrect price and description.

5. Newsletter sign-up

You can browse the Webshop selection without registering or logging in. The Seller will not accept the order in the event of incomplete filling of the mandatory data on the order. The Seller shall not be liable in any way for incorrect performance due to incorrect data. Voluntary information provided at the time of ordering serves the purpose of enabling the Seller to personally inform the User about the offer and promotions when subscribing to a newsletter. Signing up for the newsletter is completely voluntary and free. You can subscribe to the homepage under Newsletter by entering the User's e-mail address and clicking on the "Subscribe" button, at which time the User agrees to the Webshop Privacy Policy.

6. Order process

6/1) Starting purchase / selecting product (s) 
First, the Buyer will select the appropriate product and its size - in the case of wedding rings - and, if the type of stone is selectable, the type of stone and the type of the gift box. click on the “Add to Cart” icon. If you purchase other products or purchase the same product in a different size, you can go back to the products where you can put other products you want to buy into the cart.

6/2) Overview of the selected products After selecting
the desired products, you can check the selected products and their size by clicking on the "View Cart" icon on the website. You can delete the product in the cart by pressing the X button in the list action. Changes must be finalized by pressing the "Refresh Cart" button.

Delivery will be made upon receipt of the amount and will be notified by email. If you do not receive the funds within 5 business days, the order will be automatically canceled.

After placing an order, you will be redirected directly to PayPal, so your payment will be made directly to PayPal LTD. operated by a card operated by international card companies and not by the Webshop .

Buyer can place your order by clicking on the "Order" button, provided that you have read the "Terms and Conditions" and the "Privacy Statement" and ticked the box before ordering to fully accept them. The order will not be considered valid until it is completed. A new page will appear where the Buyer will receive a confirmation that the order has been successfully submitted, or if the system has found an error in the form, it will alert you and give you the opportunity to correct the error.

6/6) Order Confirmation
Within a maximum of 24 hours after the successful order is sent, the Buyer will receive an automatic confirmation to the email address that he / she provides. The confirmation shall include the ordered items, the amount to be paid together with the delivery fee and the order ID. Seller reserves the right to cancel all or part of orders already confirmed.

7. Discounts / Promotional Products

The Seller may, at its sole discretion, grant discounts to different products or to the Buyer. For promotional items, the promotion will last until the specified deadline and / or within the stock limit. Promotional prices are highlighted separately (with the original price crossed out). The Seller provides a special discount on purchasing certain products together or when reaching a certain purchase value, which is detailed in the Webshop featured pages. The discount programs are temporary and will remain in effect until revoked. Seller reserves the right at any time to revoke a discount or to modify the terms of the rebate programs. To qualify for the discounts, the conditions must be met and the discounted purchase must be completed within the program period.

Please note that the specified delivery time may vary during busy periods, depending on the load on our alloys and courier company, which will be emailed to you.

If you would like more accurate information on the delivery time of the jewelry you want to buy, make sure you email us about the current stock before placing your order.

The delivery cost and delivery time of a custom-made piece of jewelry depends greatly on the complexity and meticulousness of the piece of jewelry. Therefore, in all cases, the delivery fee and the deadline for sending the quotation will be specified by email.

Buyer may choose to ship the product (s) at home with UPS / GLS Courier Service, which may be picked up from the courier upon signature. In the absence of the consignee, the courier leaves a notice of when the consignment will be re-delivered. The price includes two delivery attempts, and if the package is not received after the second attempt, it will be returned to the Seller. UPS / GLS undertakes to deliver within the time specified above from despatch.

In all cases the cost of delivery will be added to the total amount of the order. 

Information on receipt of shipments

The total amount to be paid in your order summary and confirmation letter includes all costs. The invoice is included in the shipment. If the Buyer discovers damage to the packaging upon delivery, it may refuse to accept the delivery, subject to a record, in which case the shipment will be returned to the Seller. Subsequent non-protocol complaints about packaging damage shall not be accepted by the Seller. Seller will use its best endeavors to meet the delivery deadline set forth in clause 8 of this Agreement, which, however, is for information only and Seller is not responsible for delivery beyond the deadline. If the shipment does not arrive within the specified time, an investigation will be initiated by the carrier to clarify the circumstances, which may take several days.

9. Right of Withdrawal and Request for Exchange

9/3) Right of Withdrawal

The Buyer has the right to cancel the contract within 14 days without giving any reason. In the case of a contract for the sale of a product, the withdrawal period shall expire 14 days after the date on which the Buyer or a third party other than the carrier designated by the Buyer receives the product.

If you wish to exercise the right of withdrawal of the Buyer, you must complete the "Right of Withdrawal Statement" form by sending it to the Seller's mailing address [GTC 9/1)] or electronically to your email address [GTC 9/2)] for faster administration.

The Buyer shall exercise his right of withdrawal within the time limit if he / she sends his / her notice of withdrawal before the expiry of the above-mentioned time limit.

In exercising the right of withdrawal, the Buyer shall bear no cost other than the cost of returning the Product. The Buyer can return the ordered product, including the proof of purchase and all its accessories, to the Seller's mailing address in its original packaging by post [GTC 9/1)] . The cost of returning the product is borne by the Buyer, so the so-called cash on delivery cannot be accepted by the Seller. Make sure you return the product in perfect condition, as we can only refund the purchase price of a brand new, undamaged, undamaged product, and only in this case.
The Seller may withhold the purchase price of the Product returning to the Buyer until the Buyer has returned the Product to the Seller in full or has unequivocally confirmed that it has been returned.
Upon receipt of the shipment by our company, we will examine the returned product. This is necessary to avoid any possible future misunderstandings. (for example, the returned product was damaged or defective). If found to be correct, we will refund the value of the product to the bank account you specify within 30 days.

The Buyer may not exercise the right of withdrawal for a custom-made product that is not a pre-manufactured product made by the Seller on the Buyer's instructions or at the express request of the Buyer or a product which is clearly personalized to the Buyer.

9/4) Request replacement

The Buyer is entitled to replace the ordered product within 20 days if the size is not appropriate. In the case of a contract for the sale of a product, the period of eligibility shall expire 20 days from the date on which the Buyer or a third party other than the carrier designated by the Buyer receives the product.

If the Buyer wishes to make use of a Product Replacement, they must complete the "Resize Form" and send it electronically to the Seller's email address [GTC 9/2)].

The Seller shall only be able to replace the product with the same item number, provided that the Buyer chooses the same parameters other than the size of the product. (Eg stone-free product also stone-free; zirconia stone product also zirconia stone, etc.)

In addition to the cost of returning the product, the Buyer will be charged for the cost of shipping the new product, which will vary in each country and is included in clause 8 of the GTC. The Buyer may return the product to be returned to the Seller's mailing address in the original packaging, together with the proof of purchase and all accessories, in the original packaging [GTC 9/1)]. The cost of replacing the Product shall be borne by the Customer. Be sure to return the product in good condition as it is only possible to replace a brand new, undamaged product that is free from damage and blemishes. Upon receipt of the shipment by our company, we will examine the returned product. This is necessary to avoid any possible future misunderstandings. (for example, the returned product was damaged or defective).

If the weight and price of the product you are replacing are the same as your newly selected product, you will not be charged for the replacement, only the courier service fee, as described in clause 8 of the GTC, will be payable by transfer to the Seller. If the newly selected product is of lesser weight and price, within 30 days of receipt, the Seller shall refund the difference to the Buyer's account to the extent that the Buyer has returned the Product to the Seller in full or has unequivocally confirmed that it was returned. Otherwise, the Seller may withhold the refund due to the Buyer until receipt of the product.
If the newly selected product is more heavily weighted and priced, then the Buyer can remit the difference by referring to the Seller. The Buyer shall pay the difference to the Seller, which the Seller shall inform in writing in advance.

The Seller undertakes to replace only a product which is brand new, in good condition, free from damage and blemishes. If a replacement is requested, the Seller will arrange for the new product to be shipped as soon as possible after the return of the product, depending on the condition of the warehouse.

10. Complaints handling facilities

The Buyer may communicate to the Seller any questions, requests, comments or complaints regarding Seller's operation, products sold, or any of the following:

The reported complaint will be promptly investigated by the Seller and remedied as necessary. If an immediate investigation of the complaint is not possible or if the Buyer disagrees with the handling of the complaint, the Seller shall record the complaint and its position in a report, a copy of which shall be sent to the Buyer. Complaints submitted by telephone, mail or electronically must be answered by the Seller within 30 days. The Seller is obliged to justify the rejection of the complaint.

12. Code of Conduct

If any clause of the GTC is incomplete or legally invalid, then the remaining clauses of this Agreement will remain in effect and the provisions of the applicable Irish law will apply instead of the invalid or defective part.

The Seller does not have a Code of Conduct under the Unlawful Commercial Practices Prohibition Against Consumers Act.

13. Deadline for completion

For ordering a product in stock, the general delivery time may be up to 15 days from order confirmation, or up to 7 weeks for a product made to order. This delivery date is for information purposes only, and any departure will be notified by email.

The delivery time of a custom-designed product is highly dependent on the complexity and meticulousness of the product. Therefore, in all cases, the delivery deadline will be specified by email when you send your quotation.

14. Currency Conversion / Exchange Rate Difference

The Seller may withhold delivery of the ordered product until it is satisfied that the full purchase price of the product and the shipping costs have been successfully paid in the currency specified in the Webshop. This includes, in particular, the case where the Buyer transfers the purchase price to the currency of his Member State, as well as shipping costs and due to conversion and bank transaction costs, the Seller will not receive the full purchase price including shipping costs. In this case, the price of the product has not been paid in full, so the Seller may legitimately request the Buyer to supplement the difference.

15. Sales in the European Union

By using the webshop, the Seller does not distinguish between customers within and outside the European Union ("EU").

For purchases outside Ireland, the terms of this GTC shall also apply, with the Buyer being a consumer who is a national of, or resident in, an EU Member State, or a company domiciled in an EU Member State, within the meaning of this Agreement.

The language of communication and shopping is primarily English / Hungarian.

The Seller shall not be obliged to communicate with the Buyer in the language of the Member State of the Buyer.

The Seller shall not be obliged to comply with the laws of the Member State of the Buyer relating to the product in question and to requirements other than these GTC, such as hallmarking requirements, and to inform the Buyer thereof.

The Seller also provides non-Irish customers with ordering options to purchase the product in Ireland.

According to the GTC, the Buyer may request delivery of the product within Ireland or to the territory of any other EU Member State, or at the request of a non-Irish purchaser by any means of delivery specified in the GTC.

16. The costs of returning the product

The Buyer shall bear the cost of returning the Product. The product must be returned to the postal address specified by the Seller [GTC 9/1)] . If the Buyer terminates or cancels the order after the commencement of performance, it shall pay the Seller a fee commensurate with the service performed from the date of the order until the date of communication. The amount payable by the Buyer shall be determined on the basis of the amount specified in the order. If the Customer proves that the total amount so determined is excessive, the proportionate amount shall be calculated on the basis of the market value of the services provided up to the date of termination of the order.

17. Warranty Claims

The Seller is responsible for providing the Buyer with a defective product at the time of sale, so that the product does not have a potential defect that will become apparent at a later date. Customer's liability for defects in any product will be governed by Civil Law in Ireland.shall be governed by its relevant provisions. In the case of injuries or defects resulting from wear or misuse, cancellation cannot be enforced. The Buyer shall notify the Seller of its warranty claim as soon as possible after the defect has been discovered, but not later than within 3 business days of the discovery of the defect. The Buyer shall make a claim in a cover letter by registered mail or by e-mail for faster administration, stating the order number of the procedure and the exact name of the product complained of, indicating the item number. The named product and proof of purchase must be returned to the Seller at the specified postal address. Seller will contact Buyer within 5 business days of receiving notification, 

18. Warranty

18/1) Warranty Case

In the event of a defect in the Product, you may, at the option of the Buyer, enforce the Warranty.
Buyer may enforce a Warranty Claim against Seller in the event of Defective Seller performance under the Civil Law in Ireland.
In the event of defective performance, the Webshop issuing the invoice shall be liable.
Irish law requires that durable goods with a purchase value in excess of € 33 (or its equivalent) be covered by a warranty.

18/2) Warranty Rights

You may request repair or replacement, unless the fulfillment of a claim chosen by the Buyer would be impossible or would result in a disproportionate additional cost for the Seller to meet another claim.

18/3) Defective product case

A product is defective if it does not meet the quality requirements applicable at the time of placing it on the market or if it does not have the characteristics given by the manufacturer.

18/4) Warranty Periods of Supplies

The Buyer shall notify the defect immediately, but no later than within 3 business days of the discovery of the defect. However, please note that you may no longer enforce your warranty coverage beyond the one-year limitation period for this order.
The Buyer can enforce its product warranty claim within one year of the product being placed on the market by the manufacturer. Upon expiry of that period, he shall lose his entitlement.

18/5) Enforcement of Supplies Warranty

Buyer may enforce its warranty claims against Seller.

18/6) Conditions of Warranty Enforcement

Within six months of the date of delivery, there is no other condition for enforcing your warranty claim unless the Buyer certifies that the Product was provided by Seller. However, after six months from the date of performance, the Buyer shall be required to prove that the defect discovered by the Buyer already existed at the time of performance.

18/7) Manufacturer and Distributor Exemption from Product Liability

The manufacturer and the distributor shall only be released from their product liability obligation if they can prove that:
- they have not manufactured or marketed the product in the course of their business;
- the defect was not detected at the time of placing on the market;
- the defect in the product results from the application of a legal or regulatory requirement.
The manufacturer and the distributor need to prove one reason for exemption.
Buyer may not enforce a Warranty and Product Warranty claim for the same defect. However, if your Product Warranty Claim is successfully enforced, you may enforce your Product Warranty Claim against the replaced Product or part as against the manufacturer.

19. Copyright

The content, graphics and images contained in the Webshop are the intellectual property of the Seller. Their public use, in whole or in part, or other web site / webshop is subject to the prior and written permission of Seller. Issues not governed by these Terms and Conditions shall be governed by the provisions of the Civil Law in Ireland. Seller has the right to change the Terms and Conditions at any time without justification, provided that the changes do not affect orders in progress. The modified Terms and Conditions shall be effective as of the date of publication on the Website.
